Job Summary:
The Department of Economic Security, Office of Equal Opportunity (OEO), is seeking an experienced and highly motivated individual to join our team as an Office of Equal Opportunity (OEO) Administrator.
This position oversees the Office of Equal Opportunity (OEO) and is responsible for managing its operations. This position performs investigative work of considerable difficulty which involves broad discretion and decision making and resulting in significant financial cost savings for the Department. The Administrator must have a working knowledge and be able to interpret and apply the various laws, rules, and regulations governing nondiscrimination in employment and service delivery in order to investigate discrimination complaints from employees and service recipients, which include, but not limited to, Titles VI and VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Amendments Act of 2008 (ADAAA), the Workforce Opportunity and Innovation Act (WIOA), the Rehabilitation Services Act, the Equal Pay Act, the Arizona Civil Rights Act, etc.

Across our many agencies, boards, commissions, many State employees participate in the State's Remote Work Program and are able to work remotely in their homes, in offices, and in hoteling spaces. Job Duties:
- Managing professional staff and provides guidance through the interpretation and application of equal opportunity laws, rules, and regulations.
- Providing current, accurate, and complete information and training to OEO staff to ensure a competent and effective organization.
- Overseeing department-wide initiatives and implementation of monitoring measures to ensure compliance with federal mandates and processes.
- Advocating for the creation of positive organizational, programmatic, and policy improvements.
- Developing and delivering training related to Titles VI and VII of the Civil Rights Act, WIOA, LEP, ADA, and Section 504 of the Rehabilitation Act.
- The oversight of WIOA Title I nondiscrimination opportunity compliance requirements for the Department.
- Conducting investigations of internal complaints of discrimination filed against the Department as applicable to Title VI and Title VII of the Civil Rights Act, the ADA, and the WIOA, and prepares comprehensive investigative reports, including findings and recommendations.
- Representing the DES Director to the Equal Employment Opportunity Commission (EEOC) and other federal entities in fact-finding conferences and mediation. Develops position statements to defend the Department in charges of discrimination.
- Responding to action items and interrogatories from the EEOC and participates in the preparation of negotiated settlement and conciliation agreements.
- Consulting and providing technical assistance to the Director and Executive Leadership, management, Human Resources staff, employees, clients, and subrecipients regarding EEO, WIOA, LEP, and ADA issues.
- The development and issuance of Department reports including, but not limited to, the WIOA Nondiscrimination Plan, the ADA Transition Plan, the Language Assistance Plan, and for the preparation of OEO's response to the annual Governor's Office of Equal Opportunity report.
Knowledge, Skills & Abilities (KSAs):
Knowledge in:
- Federal and State laws pertaining to Titles VI and VII of the Civil Rights Act of 1964, as amended.
- The Americans with Disabilities Act of 1990, as amended, the Age Discrimination in Employment Act of 1973, as amended, and the Workforce Innovation and Opportunity Act.
- Federal and State laws, regulations, and executive orders pertaining to civil rights requirements.
- State personnel rules, DES program requirements, and administrative processes.
- Management techniques and interpersonal relationships to function as a manager in counseling, motivating, goal setting, and recommending personnel actions affecting staff.
Skills In:
- Monitoring and evaluation of department activities and compliance with equal opportunity initiatives.
- The elements of documenting investigative findings, including differentiating between direct and circumstantial evidence, conditions, criteria, cause, effect, and developing recommendations.
- Work management including planning, analytical research, decision making, and organizational skills.
- Mediation and negotiation.
- The field of civil rights, labor relations, and personnel management.
Ability To:
- Communicate effectively, both verbally and written, with individuals at diverse levels, both public and private.
- Pay attention to detail, identify issues, develop fully supported recommendations, and action items for implementation of recommendations.
- Analyze and produce administrative data, such as statistical analyses, annual reports, financial reports, and other various records and reports.
- Coordinate and prioritize work and activities of self and of subordinate staff.
- Establish and maintain effective interpersonal relationships to enhance collaboration at various levels within and with external partners.
- Develop executive summaries and position statements.
Selective Preference(s):
Master's degree; extensive experience in Civil Rights laws, Human Resources policies and practices.
Pre-Employment Requirements:
- Successfully complete the Electronic Employment Eligibility Verification Program (E-Verify), applicable to all newly hired State employees.

- Travel may be required for State business. Employees who drive on state business must complete any required driver training (see Arizona Administrative Code R2-10-207.12.) AND have an acceptable driving record in accordance with DES Fleet Management-Safety Program policy and procedures (DES 1-07-26 & DES 1-07-26-01). Employees may be required to use their own transportation as well as maintaining valid motor vehicle insurance and current Arizona vehicle registration; however, mileage will be reimbursed.

Retirement:
State employees are required to participate in the Arizona State Retirement System (ASRS), the State sponsored retirement contribution plan and the Long-Term Disability (LTD) program after a 27-week waiting period.
